Jefferson County Racing Association, Inc., Docket No. 1050857 (Ala., Dec. 1, 2006), reversing and rendering judgment in favor of District Attorney Barber (the "Alabama Supreme Court Opinion"). This decision reverses a lower court decision that the sweepstakes game operated at a Birmingham Alabama racetrack was legal under Alabama law. That decision was the basis for the Company operating its sweepstakes games throughout Alabama. The Alabama Supreme Court Opinion will not become a final, enforceable judgment until certain procedural time periods have elapsed, including a period of fourteen days for the filing of an application for rehearing. At present, the Company and its legal counsel are analyzing the Alabama Supreme Court Opinion and the Company's alternatives as a result of the ruling. Ultimately, the Alabama Supreme Court Opinion could result in the Company ceasing operations in Alabama.
