I know that I'm not dopey enough to think that the IPIX attorney would have failed to file a document that made clear the Company's intent to terminate the lease.
No spin, just a fact.

I'm not pretending anything.
I've read the publicly available court filings that IPIX has made (have you?) and there is no indication that IPIX sent an email during the renewal option period that explicitly stated that they did not intend to renew the lease at the time of its expiration.
One would have to be pretty dopey to think that such an email would be left out of the IPIX claims and exhibits if it existed. Even IF email wasn't specifically excluded in the lease as a method of communicating the tenant's renewal intentions (as it was) such an email would likely have mitigated against the courts finding that IPIX owed for the full term of the lease.

BTW, Leo turned over the lease termination mechanics to JH and the company bookkeeper. I guess he was too busy.

Cummings knew what they were doing and your boy didn't. And apparently neither do you.

Best as I can gauge, IPIX shareholders never had any control over IPIX.

Leo Ehrlich long neglected his fiduciary and other responsible governance responsibilities to his investors ( or “marks” as he and Mr. Bean invariably refer to you). more recently he has also decided to ignore his legal responsibilities under US Securities Laws.

Hi, Pete. Good to see your post. I agree with you that we need a "white hat" company to carry the ball from here, and it looks like our best hope is our investment in BeaMed Pharma and their StingRay laser system, which, after after a lengthy pause due to the Israel war with Hamas, has begun to move forward as demonstrated by two recent hires. Our potential there is big, along with Brilacidin. I still hold out hope.

IPIX sent no such email and the article doesn't say that it did.

The case(s) referred to in the article involved leases with similar if not identical terms regarding the notice requirements regarding automatic renewal and in one case the Judge ruled that, even though the lease explicitly precluded email as a proper method of communication, he decided as the article headline states: "Email to landlord was sufficient written notice of nonrenewal".

The Exhibit List in the IPIX/Cummins case does not include an email from anyone at IPIX during the option period indicating that there was no intention to renew the lease. It seems obvious then that even if the current Judge was inclined to accept email as an acceptable form of communication it wouldn't matter at all.

This case and the case(s) in the cited article are different in the most critical of elements.

Partner Daniel J. Dwyer was recently quoted in Massachusetts Lawyers Weekly article, “Email to landlord was sufficient written notice of nonrenewal”. The article discusses the recent ruling from the Massachusetts Appeals Court stating an e-mail by which a commercial tenant notifies its landlord that the lease will not automatically renew suffices as notice of non-renewal, even in a lease stating that e-mail notice is not effective.

In 2018, Dwyer won a similar trial against the same landlord, Cummings Properties LLC, and the verdict was affirmed on appeal. He believes that the Appeals Court has” had it” with Cummings Properties’ treatment of its commercial tenants. He went on to say that the Appeals Court, “knows that the automatic extension cases it sees represent just a fraction of the times that,” according to the trial judge in the recent case, Cummings, on receipt of notice, ”covers its ears like a child unwilling to listen to a piece of unwelcome information” in order to cause an automatic lease renewal to occur and thereby to deliver a devastating financial shock to one of its tenants.

Chilling to me that I now consider Leo in the same light as I view Biden; wouldn't trust either of them. DC got a major do-over, hope that IPIX gets the same (but then who would come to IPIX right now). It seems both have been more caring about their own fortunes than those of the public/shareholders for whom they were supposed to be working. The current rental lawsuit was the final slap in the face considering that IPIX hasn't had more than two employees (1 maybe who ever went to the office) and no need for a lab for over 10 years now and yet Leo felt we needed to lease such space. Still believe in B but IMO some white hat is going to have to come in to pick up the ball (currently deflated) and run with it.

We know that's not true, but what is true is that the victims of penny stock scam IPIX and grifter Leo Ehrlich have had to take extra jobs to make up for their heavy losses, alimony payments ("you speculated on WHAT??") and frittered away college funds.......................

Haven't checked in here in over 5 years. On a whim decided to check out the old forum I used to spend much time on back in the day. Honestly surprised there are still posts here. 

 I was very interested in this as we were told there were several drugs in the pipeline at various phases. Some in or near phase3 with potential for big partners. I still hold and will finally sell to offset gains for tax purposes. I accepted we were being strung along several years back.
