A real 3rd party receiver is not likely to appoint Brett Rosen CEO. Even if they did, they are unlikely to allow him to do what he claims he would do... It just doesn't work that way. The receiver would have complete control. The receivers first task would be to figure out what assets and debts there are through an audit of Optec. That would take a long time as much is missing, and much of what is there is fraudulent, money laundering and the like. OPTI is a VERY LONG way off from getting off the Expert Market. Whoever this "merging company" is Brett is pumping, is either complete bullshit, or another scam. So that is of no help either.

Some Stocktwit dude who is NOT a paid Rosen-SCUM shill and pump or literal "Rosen alias pump".... as 90% of them are - put it up on a Google drive.

A judge typically can not "consider" external info (ex parte info not entered on the docket etc) aka "tips" - it would not be appropriate.

MOST of these standard "motion filings" etc are handled by the Courtroom Clerk(s) for these judges - as these judges are busy as hell and handling a shit ton of cases at any given time.

They have clerks who are smart as a wit and often "hand picked" who they TRUST a great deal and who are highly competent - the Clerk drafts the expected motion response 90% of the time as this is civil law and not capital murder or whatever. The Clerk then usually confers briefly with the judge and judge says, "Sounds good" and signs it and is ready to handle the "hearing" aka today and that's how it goes down.

IF The Clerk for this judge looked at that bullshit that Rosen-Scum submitted - IF they have 2 cents of business litigation experience which is EXACTLY what this particular judge and court "deal in", they'd have put that shit motion of Rosen under "TOILET FLUSH" category of SHIT WRITTEN MOTIONS and been done with it.

The "standard way" to submit for a Receiver is GIVE THE COURT A LIST of 3 to 5 QUALIFIED CANDIDATES and then let the judge aka The Court pick one off the name list.

Rosen-SCUM did three highly suspect things:

1) They FILED NOTHING FOR MONTHS as in 6 months - then POOF "suddenly" asked via Ex Parte "HEY JUDGE, MOVE US UP THE MOTION CALENDAR MAN - FAST LIKE, WE NEED THIS FAST Bro n Dude"
MASSIVE RED FLAG - like where the F were you Rosen when you had MONTHS to file this shitty motion is what the Clerk will "see through" like tissue paper. Jamming shit onto the docket w/o EXTREMELY GOOD CAUSE will not win points with the Clerk and judge and court !

2) The filing/motion is SHIT WRITTEN - it asks for haste and move quick AND the Strickland info is SUB DOG SHIT LEVEL the way it's written.

It is now a very common and a "Customary courtesy" for a judge and The Court to give a day's notice of "MY TENTATIVE RULING" so as to make motion hearings move faster AND to give those w/o any "reason to be there" a chance to skip court AND for those with gripes to HAVE YOUR SHIT TOGETHER as this is what I the Judge am about to rule....blah ...blah....blah....it's to SAVE COURT TIME and move things along.....

I fully expect it to come out of the Expert Market. It is going to take some time to happen though. I'm expecting a good 3 or 4 month wait (possibly more) after receivership is granted to Brett. Hopefully that happens as expected on June 7th. Nothing can be done until that happens first.
