ITEM 8.01 OTHER EVENTS.
INTERNATIONAL CENTER FOR SETTLEMENT OF INVESTMENT DISPUTES (ICSID) STAYED
THE ANNULMENT PROCEEDING
On December 21, 2012, the ad hoc Committee stayed the annulment
proceeding in accordance with ICSID Administrative and Financial
Regulation 14(3)(d) and (e), pursuant to the motion of the
Secretary-General of ICSID submitted on December 19, 2012. The
Secretary-General of ICSID moved for a stay of the annulment proceeding
because the Company has not advanced an additional $150,000 pursuant to
the Secretary-General's call for funds. If the proceeding remains stayed
for non-payment for a consecutive period in excess of six months, the
Secretary-General may, after notice to and as far as possible in
consultation with the parties, move that the ad hoc Committee discontinue
the annulment proceeding.
