BEVERLY HILLS, Calif., July 10 /PRNewswire/ -- The following was released today by Aidikoff, Uhl & Bakhtiari: An NASD arbitration panel found A.G. Edwards & Sons (NYSE:AGE) liable for $258,300 for failure to properly supervise Irvine, California broker Robert Canfield. On Thursday, July 5, 2007 the NASD panel awarded $180,000 in compensatory damages and $78,300 in attorneys fees and expert witness fees to Buena Park, California optician Stephen Sokol. Dr. Sokol's law firm is Aidikoff, Uhl & Bakhtiari, a Beverly Hills and Indian Wells, California law firm that represents investors in disputes with the brokerage industry. In 2004, Dr. Sokol attended a seminar put on by A.G. Edwards and opened an account. He transferred in a number of securities purchased at another brokerage firm including a Jackson National Life variable annuity which contained his only death benefit. When the account was established Dr. Sokol explained to his brokers that as a result of a serious heart condition he was uninsurable. Dr. Sokol was approached by his son about an investment opportunity and decided to sell some of the securities in the A.G. Edwards account. Not knowing what to sell and what to keep, he left the choice to his broker who liquidated the variable annuity thus eliminating his only death benefit. "Evidence presented at the hearing established that A.G. Edwards, despite knowing that Dr. Sokol was uninsurable, chose to sell a variable annuity that contained his only death benefit which had a present value of approximately $200,000 in exchange for less than $3,400," said Philip M. Aidikoff, who tried the case. "In awarding attorneys fees and costs, the panel sent a clear message that brokerage firms have a strict obligation to monitor and control the activities of their brokers and failure to do so will have serious repercussions, both legally and financially," Mr. Aidikoff added.
